Two in Prison, Trial Set For Third Suspect in Bothell Fruit Market Armed Robbery

Two Kirkland men pleaded guilty and were sentenced to prison terms of 5.5 and five years, while the third will face trial in March 25. The three were charged in the armed robbery of Bothell's Yakima Fruit Market last spring.

Two of three Kirkland men charged last year in the armed robbery of Bothell’s Yakima Fruit Market have pleaded guilty and been sentenced to prison, while a trial date of March 25 has been set for the third.

Johnny Michael Morrow, 21, and Justin Timothy O’Dea, 22, pleaded guilty late last year. Morrow was sentenced Nov. 30 to 5.5 years in prison, ordered to seek substance abuse treatment and have no contact with the fruit market’s night manager. O’Dea was sentenced to five years in prison with the same conditions. The two were ordered to jointly pay restitution of $5,242, plus court costs.

Spencer Kyrkos, 23, faces trial March 25. He was freed from the King County Jail on conditional release in June 2012.

Washington Department of Corrections records show Morrow is now incarcerated at the Airway Heights Corrections Center near Spokane and O’Dea at the Stafford Creek Corrections Center outside Aberdeen.

The three men, all from Kirkland’s Finn Hill neighborhood, were charged with first-degree robbery in the May 6, 2012, holdup at the popular fruit market on Bothell Way. Kyrkos, who lived in Lynnwood at the time of his arrest, had previously worked at the market. Charging documents alleged the three robbed the market to support their heroin addictions.

The King County Prosecutor’s Office declined Tuesday to discuss the case against Kyrkos. But King County Superior Court records show prosecutors filed a discovery motion Jan. 30 asking the defense for the nature of its case and to state whether or not an insanity or diminished capacity argument would be used. If so, prosecutors asked to see the results of any psychiatric or other tests performed, as well as a list of names of anyone the defense would call to testify.

Bothell police cracked the case when a K-9 unit followed a scent from the market through adjacent woods to where the getaway car had been parked, and found a cell phone one of the robbers had left on the bumper.

Morrow and O’Dea committed the actual robbery, forcing at gunpoint the night manager to turn off the market’s alarm system, get a key and open its safe. Kyrkos allegedly waited at the vehicle. Morrow and O’Dea took the night manager’s identification and threatened to harm him if he told anyone.
